Lawsuit rejected for Constitution Pipeline

In August, owners of the Constitution Pipeline were disappointed when the US Court of Appeals for the Second Circuit rejected a lawsuit by the owners. The lawsuit claimed that the New York State Department of Environmental Conservation (NYSDEC) had overstepped its bounds in denying a water quality permit to the 124 mile pipeline.

The Constitution Pipeline is intended to carry natural gas from the Marcellus Shale in Pennsylvania, into New York.

Nevertheless, the pipeline's owners – which include Williams Partners (Tulsa, Oklahoma), Cabot Oil & Gas Corporation (Houston, Texas), Duke Energy Corporation (Charlotte, North Carolina) and WGL Holdings Incorporated (Washington, D.C.) – have vowed that the fight is not over.
